Getting a divorce or seperating |
| Unfortunately, the breakdown of relationships is one of the most common phenomena of our era. Divorce is rife in modern society, and the process can be painful and ugly, particularly when only one partner wants the separation or when there has been infidelity or other foul play involved. The following are a few of the questions that are asked during or before divorce proceedings, with general answers.

|
| What is a legal separation? "A legal separation is when two people begin living apart from each other. You do not need a paper or a court order to be legally separated, but many people prefer to go through the legal process of divorce in order to clarify the issue". |
| If I leave, do I have to tell my spouse where I and our children are? "You are not legally bound to tell your ex-partner where you are, but if you have taken the children along, he/she has a legal right to have contact with them, particularly if they have previously been living with you. In instances where either you or your children have been abused by your ex-partner, however, and you are concerned for their safety, you may be able to get a restraining order to prevent him/her from seeing them". |
| What can I take with me when I leave? "If you leave without any formal agreement about property, you should ONLY take items that belong to you personally, such as clothes, jewellery, toiletries and the like. If you take items that are owned jointly by you and your partner, you risk having legal action taken against you". |
